Mobilnova.com provides its products and other content (collectively, the "Mobilnova Site") subject to your compliance with the terms and conditions below. PLEASE READ THIS BEFORE ACCESSING THE MOBILNOVA SITE AND DOWNLOADING ANY PRODUCTS OR CONTENT. BY ACCESSING THE MOBILNOVA SITE OR DOWNLOADING ANY PRODUCTS, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE MOBILNOVA SITE.

Mobilnova cannot ensure or guarantee privacy for Mobilnova users. It is therefore recommended that this site not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and Mobilnova and its affiliate and related companies shall be relieved of all liability in connection therewith. Mobilnova will not intentionally monitor or disclose any private info and electronic mail messages unless required by law.

Mobilnova takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the Mobilnova Site. Further, Mobilnova makes no representations about the suitability of any of the information contained in software programs, documents and related graphics on the Mobilnova Site for any purpose. All such software programs, documents and related graphics are provided without warranty of any kind. In no event shall Mobilnova be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service.

If you are dissatisfied with the Mobilnova Site or with any terms, conditions, rules, policies, guidelines, or practices of Mobilnova in operating the Mobilnova Site, your sole and exclusive remedy is to discontinue using the Mobilnova Site.

You agree to defend, indemnify and hold Mobilnova and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorney fees, related to any violation of this terms and conditions by you or users of your account, or in connection with the use of the Mobilnova Site or the Internet or the placement or transmission of any message, information, software or other materials on the Mobilnova Site or on the Internet by you or users of your account(s).

When making purchases or other transactions through the Mobilnova Site or the Internet, you may also be asked by payment service providers to supply certain information, including credit card or other payment information. You agree that all information you provide any payment service providers through the Mobilnova Site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account and credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the Mobilnova Site. Mobilnova is in no way responsible for any charges you or any user of your account incurs when making purchases or other transactions in this manner. Software downloads are subject to the applicable EULA. You are obliged to provide a valid e-mail address when you buy any products or services on the Mobilnova site. Mobilnova should send all necessary registration credentials to the provided e-mail address within 3 business days after receiving your payment confirmation. Mobilnova takes no responsibility in case you supplied an incorrect e-mail address, or the e-mail has not reached you because of a technical reason, or if you are unable to access the provided e-mail address for any other reason. In no event will Mobilnova refund any purchases of payments made on the Mobilnova Site or via its payment service providers. From 1 November 2010 we can update Media Center license for a one-time fee, determined at the time of request. Media Center license is valid for one TomTom device at a time.

When entering your email address and downloading any products content from Mobilnova Site (including demo versions of software) you agree to be included in the database for future communications regarding this software. You should only enter your own and valid email address, which you confirm by agreeing to this terms and conditions.

THE SOFTWARE CONTAINED AND DOWNLOADED FROM THE MOBILNOVA SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS AND THE PERFORMANCE OF THE SOFTWARE IS ASSUMED BY THE USER, AND IN NO EVENT WILL MOBILNOVA BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR DIRECT DAMAGES SUFFERED IN THE COURSE OF USING THE SOFTWARE. USE OF THE FREEWARE AND SHAREWARE PROGRAMS CONTAINED IN THE PACKAGES ARE GOVERNED BY THEIR RESPECTIVE LICENSE AGREEMENTS AND MAY CONTAIN RESTRICTIONS ON USE INCLUDING, BUT NOT LIMITED TO, THE REQUIREMENT(S) TO PAY THE AUTHOR(S) A SPECIFIED AMOUNT AFTER A TRIAL PERIOD HAS ELAPSED.

These terms and the supply of products or services shall be governed in accordance with the laws of the Netherlands. Any dispute arising under these terms of sale and the supply of goods shall be subject to the exclusive jurisdiction of the Dutch courts and the parties waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inappropriate forum.

Mobilnova and other names, logos and icons identifying Mobilnova and its products and services referenced herein are trademarks or registered trademarks of Mobilnova. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.
